• McCann's Engineering and Mfg. Co. warrants the products it manufactures to be free of original defects in material or workmanship for a period of one year from date of installation or fifteen months from date of shipment from its factory - whichever comes first.
• McCann's will repair or at its option replace, F.O.B. its factory (in Los Angeles, California), any product which upon inspection at its factory is found to be defective within the above mentioned periods. All product returned to McCann's must have all transportation charges prepaid.
• McCANN'S MAKES NO EXPRESS WARRANTIES AND NO IMPLIED WARRANTIES, WHETHER OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR USE, OR OTHERWISE (EXCEPT AS TO TITLE), OTHER THAN THOSE EXPRESSLY SET FORTH ABOVE AND WHICH ARE IN LIEU OF ALL OTHER WARRANTIES. NO WAIVER SHALL BE VALID UNLESS MADE IN WRITING AND SIGNED BY AN EXECUTIVE OFFICER OF McCANN'S.
• McCann's shall not be liable for injury to person or property other than the products themselves nor for installation or service of defective products nor loss of profits or any consequential damages. In no event shall damages exceed the purchase price of the product.
• Any action for breach of warranty, contract, negligence or other tort must be commenced within one year after the cause of action has occurred in the County of Los Angeles, State of California.
• Products of other manufacturers furnished as components of McCann's product will carry the standard guarantees of the manufacturers involved.
• The protection of this warranty does not extend to any damage or failure to operate resulting from any accident, misapplication, alteration, abuse or misuse. No responsibility is assumed for damage during transit for which damage claims should be filed against the carrier.
